Terms & Conditions

1. Introduction

These Terms and Conditions govern the provision of painting and decorating services by Hampstead Painting Company ("we," "us," or "our") to customers ("you" or "your"). By engaging our services, you agree to be bound by these terms.

2. Services

2.1 Scope of Work

We provide professional painting, decorating, and related services as specified in our written quotations and agreements. All work will be carried out:

  • In a professional and workmanlike manner
  • In accordance with industry best practices
  • Using quality materials from reputable suppliers
  • By qualified and experienced personnel

2.2 Quotations and Estimates

All quotations are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on site visits and information provided by you. If conditions differ materially from those assessed, we reserve the right to revise the quotation.

2.3 Variations

Any changes to the agreed scope of work must be confirmed in writing and may result in additional charges. We will provide revised quotations for your approval before proceeding with variations.

3. Pricing and Payment

3.1 Pricing

All prices are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated. Prices include:

  • Labor and supervision
  • Materials as specified in the quotation
  • Standard surface preparation
  • Site cleanup upon completion

3.2 Payment Terms

Unless otherwise agreed in writing, payment terms are as follows:

  • Small Projects (under £2,000): Payment in full upon completion
  • Medium Projects (£2,000 - £10,000): 30% deposit, balance upon completion
  • Large Projects (over £10,000): 30% deposit, stage payments as agreed, final 10% upon completion

Invoices are due within 14 days of issue unless otherwise agreed. We reserve the right to charge interest on overdue accounts at a rate of 4% above the Bank of England base rate.

3.3 Accepted Payment Methods

We accept payment by:

  • Bank transfer (preferred)
  • Credit or debit card
  • Cheque (subject to clearance)
  • Cash (for amounts under £500)

4. Customer Obligations

4.1 Access and Preparation

You agree to:

  • Provide clear access to all areas requiring work
  • Remove valuable, fragile, or personal items from work areas
  • Ensure utilities (electricity, water) are available
  • Provide accurate information about property conditions
  • Disclose any hazardous materials (e.g., asbestos)
  • Obtain any necessary permissions (e.g., for listed buildings)

4.2 Pets and Occupancy

You must inform us if pets will be present during work. You are responsible for restraining pets and ensuring our team's safety. If the property will be occupied during work, please inform us in advance.

5. Our Obligations and Standards

5.1 Insurance

We maintain comprehensive Public Liability Insurance (£10 million) and Employers' Liability Insurance as required by law. Certificates are available upon request.

5.2 Health and Safety

We comply with all relevant health and safety legislation and conduct risk assessments for all projects. Our team uses appropriate safety equipment and follows safe working practices.

5.3 Environmental Responsibility

We dispose of all waste materials in accordance with environmental regulations and use low-VOC products where possible.

6. Warranty and Guarantees

6.1 Workmanship Warranty

We guarantee our workmanship for 2 years from the completion date. This warranty covers:

  • Defects in application technique
  • Peeling or flaking due to poor preparation
  • Coverage issues

6.2 Warranty Exclusions

Our warranty does not cover:

  • Normal wear and tear
  • Damage caused by building movement or settlement
  • Moisture or damp issues not disclosed or present at time of work
  • Damage caused by third parties
  • Areas not prepared or painted by us
  • Color fading due to exposure (external surfaces)
  • Manufacturer defects in materials (covered by manufacturer warranties)

6.3 Warranty Claims

To make a warranty claim, contact us in writing within 14 days of discovering the defect. We will inspect the issue and, if covered, remedy it at no additional cost.

7. Cancellations and Changes

7.1 Cancellation by Customer

  • Before work commences: Full refund minus £150 administration fee
  • After work has started: Charges for work completed plus materials purchased
  • Less than 48 hours before scheduled start: 25% of contract value

7.2 Cancellation by Us

We reserve the right to cancel a contract if:

  • You fail to make required payments
  • Access is not provided as agreed
  • Hazardous conditions are discovered that were not disclosed
  • You breach these terms

In such cases, you will be charged for work completed to date.

8. Delays and Extensions

While we endeavor to complete all work within agreed timeframes, completion dates are estimates. We are not liable for delays caused by:

  • Adverse weather conditions (for external work)
  • Discovery of unforeseen issues
  • Material supply delays
  • Customer-requested changes
  • Lack of access
  • Force majeure events

9. Liability and Indemnity

9.1 Limitation of Liability

Our liability under this agreement is limited to the value of the services provided. We are not liable for:

  • Indirect or consequential losses
  • Loss of profits or business
  • Damage to items not removed from work areas as requested
  • Pre-existing defects or damage

9.2 Customer Indemnity

You agree to indemnify us against any claims arising from:

  • Inaccurate information provided by you
  • Failure to disclose material facts
  • Breach of your obligations under this agreement

10. Intellectual Property

Any bespoke designs, color schemes, or decorative treatments created by us remain our intellectual property unless otherwise agreed in writing.

11. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy and applicable data protection legislation.

12. Complaints Procedure

If you are dissatisfied with our services:

  1. Contact your project manager or our customer service team within 7 days
  2. We will investigate and respond within 14 days
  3. If unresolved, you may escalate to our director
  4. As members of trade associations, you may refer disputes to their mediation services

13. Dispute Resolution

We are committed to resolving disputes amicably. If a dispute cannot be resolved through discussion, both parties agree to first attempt mediation before pursuing legal action.

14. Entire Agreement

These terms, together with our quotation and any written agreements, constitute the entire agreement between us and supersede all prior agreements, representations, or understandings.

15. Governing Law

These terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Amendments

We reserve the right to amend these terms at any time. Amendments will not affect contracts already entered into.
